MYER CENTREPOINT: SPRING GIFT WITH PURCHASE CAMPAIGN
“SPRING FLING | SHOP, SNAP, WIN”

Information on how to enter and prizes form part of these Terms and Conditions. Participation in this “Spring Fling | Shop, Snap & Win” (“Promotion") is deemed acceptance of these Terms and Conditions.

ELIGIBILITY
1. Subject to condition 2, this Promotion is open to residents aged 18+ who shop in-centre at Myer Centrepoint, Albury during the promotional period.
2. The following are ineligible: The Promoter (Myer Centrepoint managed by RetPro Group Pty Ltd) employees and the immediate families of the Promoter, Subcontractors, and the agencies associated with this promotion are ineligible to enter. Immediate families mean parents, siblings, spouse, children and grandparents.

PROMOTION PERIOD
Promotion commences at 9am (AEST) 30/09/2024 and concludes at 12.00pm (AEST) 30/10/2024
Prizes for this promotion are redeemable instantly, winners will receive confirmation of prize & redemption instructions once prize is selected.
Winners of the major prize draw will be contacted on the 11/10/2024 prior to COB (AEST)

UNCLAIMED PRIZES
If any prize remains unclaimed it will be either forfeited or added to the unclaimed prize draw consisting of a pool of all entrants. The unclaimed prize draw will take place at the Myer Centrepoint Centre Management Office at 525 David Street, Albury NSW 2640 on 11/12/2024 at 10:00am AEST. The new winning entrant/s will be notified in writing by email and phone within two (2) business days of the draw.
EXCLUDED RETAILERS
Excluded retailers include: Woolworths, BWS, Hume Bank, Myer, Essence Audiology, Medibank Private, Coady Davenport Optical. Retailers reserve the right to participate or withdraw from the promotion at any time. Entrants are encouraged to verify a retailers participation, with their retailer prior to purchasing.
GENERAL
1. Prizes are not transferable or exchangeable and cannot be redeemed for cash.
2. The Promoter reserves the right, at any time, to verify the validity of an entry and reserves the right, in its sole discretion, to disqualify any eligible entrants that the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion.
3. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any eligible people; or (b) subject to any written directions from a regulatory authority to modify, suspend, terminate or cancel the Promotion, as appropriate.
4. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
5. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an eligible business; or (f) use of a prize.
PRIVACY
1. To conduct this Promotion, the Promoter needs to collect the personal information of all individuals who enter the major prize draw, and may for this purpose, disclose such information to the prize supplier and regulatory authorities. Participation in the Major Prize Draw portion of the Promotion is conditional on an individual providing this information. It is a condition of entry that the entrant’s parent/guardian agrees to being entered into the Myer Centrepoint database. Myer Centrepoint will for an indefinite period, unless otherwise advised, use the information for promotional and marketing, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Privacy Policy. All personal details will be stored in accordance with the Privacy Policy. Upon request, all information provided will be removed from our active database.
